These Terms of Sale are entered into between:

Article 3. Acceptance of the Terms of Sale
The Customer must read these Terms of Sale before placing any Order. Validation of an Order constitutes the Customer’s express and unconditional acceptance of the Terms of Sale in force at the time of payment.
The Terms of Sale are available at all times on the Site at https://roogle.app/terms or on any dedicated sales terms page if a separate page is created at a later date.
TNJ Alpine Technologies recommends that the Customer download or print the Terms of Sale applicable at the time of the Order.
TNJ may amend these Terms of Sale at any time for the future, particularly to reflect changes to the Service, prices, plans, regulations or service providers used.
Article 4. Order conditions
4.1. Creation and use of the Account
To subscribe to a Paid Plan, the User must have a Roogle Account or create one before payment or during the subscription process. The creation and use of the Account are governed by the General Terms of Use.
The User is responsible for the accuracy of the information provided, the confidentiality of their Credentials and the use of their Account.
Any use of the Account is presumed to have been carried out by its holder unless proven otherwise or unless a failure attributable to TNJ is established.
4.2. Description of Paid Plans
The essential characteristics of the Paid Plans are presented on the Site before the Order is placed.
They may include:
- A higher number of saved searches and/or Alerts compared with the free plan;
- Access to more frequent or more advanced Alerts;
- Access to Telegram notifications for Premium Users where this feature is available;
- Access to advanced filters, including surface area, number of rooms, move-in date or other available criteria;
- Easier access to Original Sources, within the limits indicated on the Site;
- Priority, convenience or customisation features displayed on the subscription page.
The free plan may be limited in terms of the number of favourites, saved searches, Alerts, Source openings or other features.
The exact limits are those displayed on the Site at the time of use or the Order.
TNJ Alpine Technologies may change the features of the plans, provided that it does not remove an essential feature from a plan that has already been paid for without a legitimate reason or without taking an appropriate measure for the Customer.
4.3. Premium Subscription
The Premium Subscription is a recurring payment plan.
Unless otherwise indicated on the Site, it is subscribed to for a monthly period and renews automatically for successive periods of the same duration until cancelled by the Customer or TNJ in accordance with these Terms of Sale.
The price of the Premium Subscription is the price displayed on the Site at the time of subscription.
As of the date of these Terms of Sale, the Premium plan may be offered at an indicative price of CHF 9.90 per month, subject to changes, promotions, pricing tests or differences in the prices displayed on the Site.
4.4. 30-Day Pass
The 30-Day Pass is a non-recurring paid plan.
It provides access to the features indicated on the Site for thirty (30) days from the date of activation.
It does not renew automatically unless the Customer expressly accepts otherwise when placing the Order.
When the 30-Day Pass expires, the Customer’s Account may automatically revert to the free plan or to any other plan the Customer may hold.
4.5. Order procedure
To order a Paid Plan, the Customer is invited to follow the steps displayed on the Site, including:
- Selecting the desired plan, such as Premium or the 30-Day Pass;
- Logging in to their Account or creating an Account;
- Reviewing the essential characteristics of the plan, its price, duration, whether the payment is recurring or non-recurring and any applicable limits;
- Accepting the Terms of Sale and, before payment, selecting a separate checkbox requesting immediate access to the paid features and acknowledging the loss or limitation of the fourteen (14)-day withdrawal right under the conditions provided by applicable law;
- Being redirected to Stripe’s secure payment interface;
- Confirming payment;
- Receiving an Order confirmation by e-mail or through the Account interface.
Access to paid features is generally activated automatically after Stripe confirms payment.
A reasonable technical delay may nevertheless be required.
Article 5. Prices, payment and invoicing
5.1. Prices
The prices of the Paid Plans are displayed on the Site before the Order is confirmed.
Unless otherwise indicated, prices are displayed in Swiss francs (CHF).
TNJ Alpine Technologies is not subject to Swiss VAT as of the date of these Terms of Sale.
Accordingly, prices are indicated without Swiss VAT for as long as TNJ is not subject to it.
If TNJ subsequently becomes subject to VAT or if a tax obligation applies in a particular country, the applicable taxes may be added, included or displayed in accordance with the rules in force and the information shown on the Site.
TNJ reserves the right to change prices at any time.
For active Premium Subscriptions, any price change applicable upon renewal will be communicated in advance within a reasonable period.
The Customer may cancel the subscription before the new price takes effect.
5.2. Payment methods
Payments are made by bank card or any other payment method offered on the Site through Stripe, a secure payment provider.
TNJ Alpine Technologies does not store the Customer’s complete bank card details.
The Customer confirms that they are authorised to use the selected payment method and that the information provided is accurate and up to date.
5.3. Recurring payment of the Premium Subscription
By subscribing to the Premium Subscription, the Customer authorises TNJ Alpine Technologies, through Stripe, to automatically charge the registered payment method at each renewal period until cancellation.
If payment fails, TNJ or Stripe may make further payment attempts and/or invite the Customer to update their payment method.
If payment is not successfully completed, TNJ may suspend or terminate access to Premium features.
5.4. Invoices
Where the relevant feature is available, invoices or payment receipts may be accessed through the Customer’s Account or sent by e-mail.
The Customer is responsible for the accuracy of the billing information entered in their Account or in the Stripe interface.
Article 6. Duration, renewal and cancellation
6.1. Duration
The Premium Subscription is entered into for the period indicated on the Site at the time of subscription, generally one (1) month with automatic renewal.
The 30-Day Pass is entered into for a fixed period of thirty (30) days and does not renew automatically.
6.2. Cancellation by the Customer
The Customer may cancel their Premium Subscription at any time through their Account, through the Stripe management portal where available, or by contacting TNJ at contact@roogle.app.
Cancellation takes effect at the end of the current billing period unless otherwise stated or required by mandatory law.
The Customer generally retains access to Premium features until the end of the period already paid for.
The 30-Day Pass does not require cancellation because it automatically expires at the end of the thirty (30)-day period.
6.3. Suspension or termination by TNJ
TNJ may suspend or terminate access to Paid Plans in the event of non-payment, fraud, abuse, abnormal use of the Service, attempted circumvention of limits, bulk data extraction, breach of the General Terms of Use or breach of these Terms of Sale.
Where reasonably possible, TNJ will inform the Customer before suspension or termination, except in cases of urgency, security risk, fraud, serious breach or legal obligation.
Article 7. Withdrawal rights, cancellation and refunds
Withdrawal rights depend in particular on the Customer’s country of residence and the applicable mandatory rules.
7.1. Customers located in Switzerland
Subject to applicable mandatory rules, Swiss law does not provide for a general right of withdrawal for online purchases.
TNJ may nevertheless grant a commercial refund on a case-by-case basis, without this creating a general obligation or an acquired right for future Orders.
7.2. Consumer Customers located in the European Union or in a country providing a mandatory right of withdrawal
Where the Customer benefits from a mandatory right of withdrawal, they may generally withdraw within the period provided by applicable law, including fourteen (14) days for European Union consumers in the cases provided by applicable regulations.
For Customers who benefit from a right of withdrawal, access to Roogle’s Paid Plans is provided as a digital service available immediately after payment.
Where the Customer selects the dedicated checkbox before payment, they expressly request that performance of the Service begin immediately, before the expiry of the withdrawal period.
By selecting this checkbox, the Customer expressly acknowledges that they lose their fourteen (14)-day right of withdrawal as soon as the Service is immediately activated, where such loss is permitted by applicable law.
Alternatively, any refund may be excluded or limited on a pro rata basis according to the portion of the Service already provided where required by applicable law.
The recommended wording for the checkbox is:
“I request immediate access to Roogle’s paid features before the end of the statutory 14-day withdrawal period, and I acknowledge that I lose my right of withdrawal as soon as the Service is immediately activated, under the conditions provided by applicable law.”
This checkbox must be separate from the checkbox accepting the Terms of Sale, must not be pre-selected and must be retained as evidence of consent during the Order process.
7.3. Refunds
Unless otherwise required by law, subscription periods that have already commenced and activated 30-Day Passes are non-refundable, particularly where the Customer has selected the immediate-access checkbox and has actually benefited from Roogle’s paid features.
No refund will be payable where suspension or termination results from fraud, abuse, non-payment or a serious breach of the General Terms of Use or these Terms of Sale by the Customer.
Refund or withdrawal requests must be sent to contact@roogle.app, stating:
- The e-mail address associated with the Account;
- The Order date;
- The payment or invoice reference, where available;
- The reason for the request, where the Customer wishes to provide one.
Article 8. Record keeping and evidence
Electronic records retained in the systems of TNJ, its technical service providers or Stripe may be used as evidence of communications, Orders, payments, subscriptions, renewals, cancellations and actions performed through the Account.
Invoices, payment receipts and accounting documents are retained for the period required by applicable legal, tax and accounting obligations.
Article 9. Operation, availability and updates of the Service
Roogle is an evolving digital service.
TNJ may carry out maintenance, correction, improvement, security or update operations that may result in the temporary unavailability of the Site or certain features.
TNJ uses reasonable efforts to ensure the availability of the Site but does not guarantee permanent, uninterrupted, error-free or incident-free access.
The Service depends in particular on the internet, technical service providers, browsers, devices used by the Customer, Source platforms and third-party interfaces.
TNJ may modify, add or remove features, Sources, cities, countries, categories or filters where necessary for the development of the Service, security, legal compliance, data quality, prevention of abuse or technical constraints.
Article 10. Liability
10.1. Nature of the Roogle Service
Roogle is a search, aggregation, structuring and alert platform for public rental listings.
Roogle is not a real-estate agency, property manager, representative, broker, contractual intermediary in rental transactions or guarantor of the conclusion of a lease.
TNJ does not guarantee that the Customer will find accommodation, receive a response from a landlord, be selected for a rental or enter into a lease through the Service.
10.2. Listings and Original Sources
Listings referenced on Roogle originate from public Original Sources and third parties.
The information may be incomplete, outdated, inaccurate, duplicated, fraudulent, removed, modified or unavailable on the Original Source.
TNJ does not guarantee the accuracy, timeliness, availability, legality, quality, price, photographs, identity of the publisher or existence of the accommodation referred to in the Listings.
The Customer must carry out their own checks before making contact, making a payment, attending a viewing, submitting an application or entering into a contract.
Links to Original Sources are provided for convenience.
The Customer acknowledges that third-party platforms, groups, forums, messaging services and websites have their own terms of use, privacy rules and reporting mechanisms.
10.3. Fraud, scams and security
The Customer is advised to remain cautious regarding requests for advance payment, unsecured deposits, requests for sensitive documents, offers that appear excessively attractive, suspicious external links and persons who refuse standard verification procedures.
TNJ may provide indicators, filters, detection mechanisms or warnings, but these do not constitute a guarantee that fraud or risk is absent.
10.4. Limitation of liability
To the extent permitted by applicable law, TNJ shall not be liable for indirect damage, loss of opportunity, loss of chance, financial loss linked to a third party, temporary unavailability, data errors originating from Sources or decisions made by the Customer based on information viewed on Roogle.
TNJ shall not be liable for any failure or defective performance attributable to the Customer, a third party, the Original Source, an external service provider, force majeure or use of the Site that does not comply with these Terms.
Article 11. Customer obligations
The Customer agrees to use the Site in accordance with the General Terms of Use, these Terms of Sale, applicable laws and the rights of third parties.
In particular, the Customer agrees not to:
- Use the Service for fraudulent, illegal or abusive purposes or in a manner contrary to its intended purpose;
- Extract, crawl, copy, resell, republish or reuse the Roogle database on a large scale without prior written authorisation;
- Circumvent the technical, pricing or functional limits of the Service;
- Share their Account or Premium access with third parties without TNJ’s written authorisation;
- Compromise the security, availability, integrity or operation of the Site;
- Use collected information to harass third parties, spam publishers or breach the rules of Original Sources.
Any breach of these obligations may result in suspension or termination of the Account and/or Paid Plan, without prejudice to any other remedies available to TNJ.
Article 12. Force majeure
TNJ shall not be liable for any delay or failure to perform resulting from an event reasonably beyond its control, including major hosting failure, cyberattack, network incident, unavailability of an essential service provider, administrative decision, regulatory change, natural disaster, war, riot, strike, power outage or any other force majeure event recognised under applicable law.
In the event of force majeure, TNJ will endeavour to restore the Service within a reasonable period and to inform Customers where appropriate.
Article 13. Personal data
In connection with the sale and provision of Paid Plans, TNJ processes personal data relating to Customers, including Account, billing, payment, support, Alert preference and Service usage data.
The conditions governing the processing of personal data are described in the Privacy Policy available at https://roogle.app/privacy.
Information concerning cookies and trackers is described in the Cookie Policy available at https://roogle.app/cookies.
Article 14. Customer Service
Any question, complaint, refund request or request relating to an Order, invoice or cancellation may be sent to TNJ Alpine Technologies by e-mail at:
TNJ may also provide support through Crisp or any other support tool indicated on the Site.
Support is not intended to provide legal, real-estate, tax or financial advice.
Article 15. Amendment of the Terms of Sale
TNJ may amend these Terms of Sale at any time.
The applicable Terms of Sale are those in force at the time of the Order or, for a Premium Subscription, those accepted at the time of subscription, subject to amendments applicable to renewals after prior notice to the Customer where necessary.
If a material amendment to the Terms of Sale adversely affects an active Premium Subscription, TNJ will inform the Customer within a reasonable period.
The Customer may cancel the subscription before the amendment takes effect, in accordance with the stated procedure.
Article 16. Validity
If any provision of these Terms of Sale is declared invalid, unenforceable or deemed unwritten, the remaining provisions shall remain in force.
The Parties will endeavour to replace the affected provision with a valid provision that reflects the original economic and legal objective as closely as possible.
The fact that TNJ does not rely on a provision of the Terms of Sale at a particular time does not constitute a waiver of the right to rely on it at a later date.
Article 17. Governing law and jurisdiction
These Terms of Sale are governed by Swiss law, subject to any mandatory consumer protection rules that may apply to the Customer due to their country of residence.
In the event of a dispute, the Customer is invited to contact TNJ at contact@roogle.app in order to seek an amicable solution.
Subject to applicable mandatory consumer jurisdiction rules, any dispute relating to the validity, interpretation, performance or termination of these Terms of Sale shall fall within the jurisdiction of the competent courts of the Canton of Geneva, Switzerland.
